Definitions used herein include:
"BUYER" shall herein be defined as: The person/persons who purchase the new puppy
"BREEDER" shall herein be defined as: The person/persons selling the puppy
"PUPPY" shall herein be defined as: A German Shorthaired Pointer puppy

A pet PUPPY is defined here to be a German Shorthaired Pointer (herein be defined as GSP) PUPPY that is in good health at the time of sale, and embodies the characteristics of the GSP breed. This PUPPY is purebred and is registerable with the American Kennel Club.
The parents of this PUPPY have had x-rays to establish that they are free of hip and elbow dysplasia. The PUPPY is guaranteed to be free of hip and elbow dysplasia through 12 months old.
This PUPPY is registered with breeding rights. This will be allowed to be bred after the terms of this contract have been met. Terms for breeding rights include:
* It is agreed that the puppy who is purchased by the family will reside with the family 100% of the time unless the family violates this contract or chooses to surrender the puppy.
* It is agreed that the puppy will be surrendered to me in violation of this contract.
* The puppy will be returned/surrendered to me if there is any accidental breeding at my discretion.
* The puppy will be registered in my name exclusively. There is no co-ownership.
* The puppy will not be bred before age 2.
* The puppy will not be bred before either: AKC Show Championship, AKC Senior Hunter or AKC Master Hunter title.
* The puppy will not be bred before all health clearances are done with passing scores. This includes eyes, hips, elbows, heart and all results reported to Orthopedic Foundation Of Animals.
* This puppy will not be bred without CHIC certification through the Orthopedic Foundation Of Animals.
* Puppy will be degenerative myelopathy (DM) tested. In the event the puppy is a carrier, the puppy will be bred to a DM negative partner only. Testing results provided to me for verification.
* I agree to transfer ownership of the puppy to the puppy buyer after the terms of this contract are met.
* There are no refunds in the event of no titles.
* If you purchase a female, the female will only be bred 3 times with 1 rest in between one of the three breedings. In my program we breed back to back, rest, then breed one last time. Which breeding you rest is up to you.
Under this LIMITED HEALTH GUARANTEE, your PUPPY is guaranteed against a non-curable congenital or hereditary defect for a period of one year from the date of the PUPPY’S birth. In order to arrange a replacement puppy, you must obtain a written diagnosis of a non-curable congenital problem from a licensed veterinarian. A replacement puppy will be provided with the return of your current puppy.
This limited health guarantee does not include an acquired illness/virus or any illness from an immune deficiency issue (I cannot control what puppy is exposed to outside my kennel). In the event of sudden death, the PUPPY must be examined by a licensed veterinarian to determine that the PUPPY wasn’t hit by a car, bitten by a snake, etc. A replacement puppy will be if he/she died of natural causes.
The BUYER agrees to AKC register the PUPPY.
The BUYER agrees to provide at least 1 bottle (90 day supply) of NuVet Plus vitamins available at www.nuvet.com/80373 or by calling 800-474-7044 order code 80373. It is understood that no puppy goes home without these vitamins pre-purchased.
The BREEDER does not assume any liability for any injury to said PUPPY during delivery. If your puppy is being shipped, shipping is at your discretion and risk. This includes accidental death, loss, heat stroke, cold etc.
Your PUPPY has been wormed, vaccinated and examined by Dr. Euers of Animal Hospital of Katy and determined to be healthy. A vet exam after the PUPPY leaves my premises is not required for the health guarantee. The next set of shots is due at 12 weeks old and 16 weeks old.
No puppy is allowed to be on Trifexis.
BREEDER is not liable for PUPPY vaccination adverse reactions as this would not be the fault of the BREEDER.
There are many factors that can influence growth and development, such as diet, exercise, weight gain, etc. The BUYER assumes the responsibility to carry on with the appropriate vaccinations, exercise and feeding schedule.
The BUYER agrees that neither he/she nor the BUYER'S estate/executors may sell this PUPPY or transfer ownership of this PUPPY without the BREEDER'S knowledge and written consent.
The BUYER hereby agrees that if at any time the Buyer cannot take proper care of the PUPPY, the BUYER must contact the BREEDER and the BREEDER will have the first choice to either: (a) take the PUPPY back or (b) assist the BUYER in finding a suitable home for the PUPPY.
In the event of PUPPY surrender, there is no buy back from the BREEDER.
The BREEDER neither makes nor implies any warranties or guarantees other than those written in the agreement including, without limitation, the warranties of merchantability and fitness. All sales are final with no refunds other than the health guarantee which is a replacement puppy with the return of your puppy. This document constitutes the entire agreement between the BREEDER and BUYER with respect to this sale. The BUYER’s signature below indicates that he/she has read, agrees and does understand all the conditions of this Sales Agreement and Contract.
